1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Riveting Agency, Inc. d/b/a SalesBriefAI.com ("Company," "we," "us," or "our") regarding your use of the SalesBriefAI™ service (the "Service") and our website at salesbriefai.com (the "Website").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

2.1 SalesBriefAI™ Service

SalesBriefAI™ is an AI-powered microservice that generates sales intelligence briefings based on prospect and salesperson information you provide. The Service uses artificial intelligence technology from multiple providers to research and analyze publicly available information and produce comprehensive sales briefings delivered via email.

2.2 Starter Plan

New accounts are enrolled in our Starter Plan (the "Starter Plan"). Starter Plan users receive complimentary credits to evaluate Service functionality. We may introduce additional plans, and we may change the credits included with the Starter Plan on a forward-looking basis.

2.3 Service Delivery Target

We target delivery of briefings within 15 minutes of order submission. This is a target timeframe, not a guarantee, and actual delivery times may vary based on system load, data availability, and technical factors.

3. User Eligibility and Account Requirements

3.1 Age and Capacity

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use the Service.

3.2 Account Registration

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Credit System and Payment Terms

4.1 Credit-Based Service

The Service operates on a credit-based system where each briefing costs 100 credits, with additional services costing additional credits as specified during ordering.

4.2 Starter Credits

Starter Plan users receive 500 complimentary credits upon account creation. Additional credits may be earned through surveys, referrals, or other promotional activities at our discretion.

4.3 Credit Expiration

Credits are held as a single account balance. They are valid for 12 months from the date they are purchased or granted, and we will not forfeit credits on an account that has had a credit purchase or a briefing order within the preceding 12 months. If an account goes 12 consecutive months with no purchase and no briefing order, we may forfeit the unused balance; forfeited credits have no monetary value, subject to applicable unclaimed-property laws.

We do not track credits as separate dated lots, we do not consume them in a first-in, first-out order, and we do not send automated expiration warning emails. Forfeiture is not automated: it is applied by hand, on review. If we introduce dated credit lots, automated forfeiture, or expiration notices, we will update these Terms before doing so.

5. Use of the Service

5.1 Permitted Uses

You may use the Service to:

• Generate sales intelligence briefings for legitimate business purposes
• Research prospects for sales outreach and relationship building
• Use generated briefings for automated or bulk outreach campaigns
• Share briefings within your organization

5.2 Prohibited Uses

You may not:

• Use the Service to build competing AI tools or sales intelligence services
• Systematically extract data beyond what is provided in your purchased briefings
• Share account credentials or transfer credits between unrelated accounts
• Use the Service in violation of applicable laws or regulations
• Use the Service for harassment, stalking, or other harmful purposes

6. AI Technology and Service Limitations

6.1 AI-Generated Content

Our Service uses artificial intelligence technology from OpenAI, Anthropic, Google, and other providers to generate briefings. AI-generated content may contain errors, inaccuracies, or biases despite our quality control measures.

6.2 No Guarantees of Accuracy

IMPORTANT: AI-generated briefings are provided for informational purposes only. We do not guarantee the accuracy, reliability, or completeness of any information in our briefings. You must independently verify all information before making business decisions.

6.3 Refund Policy

If a briefing does not meet your expectations, you may request a credit refund for that briefing — directly from the briefing's feedback link (tell us what went wrong when you rate it) or by contacting our support team at legal@salesbriefai.com.

We may limit automatic refunds where we detect a pattern of misuse. In those cases, refund requests are reviewed individually by our support team, and we will always work with you to find a fair outcome.

7. Intellectual Property Rights

7.1 Service Ownership

The Service, Website, and underlying technology are owned by Company and protected by intellectual property laws.

7.2 Briefing Content License

Upon delivery of a briefing, you receive an unlimited, global, royalty-free license to use the text content we generate for you. You may modify, redistribute, and commercialize this content without restriction.

8. Disclaimers and Limitations of Liability

8.1 Service Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed:

• For users who have not made a payment: $0 (zero dollars)
• For users who have made a payment: the amount of your most recent payment to us

9. Termination

You may terminate your account at any time by contacting us at legal@salesbriefai.com or through account settings. Upon termination, your access to the Service will cease and unused credits will be forfeited.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or abusive behavior, or use the Service in ways that harm our business or other users.

10. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration rather than in court. Arbitration shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association in Phoenix, Arizona.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.
